14. Dispute Resolution and Arbitration

14.1 Informal Resolution

We will attempt in good faith to resolve the dispute informally within thirty (30) days of receiving your notice. EXCEPT WHERE PROHIBITED BY LAW, YOU AND JET'S PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE USE OF OUR SERVICES SHALL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT. Arbitration shall be conducted in accordance with the rules of a recognized arbitration association (such as the American Arbitration Association) and shall take place in the jurisdiction of our principal place of business or via remote proceedings as mutually agreed.

The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to award any remedy that would otherwise be available in court, except that the arbitrator shall not have the authority to award punitive damages beyond those permitted under applicable law.

14.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims or preside over any form of a class action proceeding, unless otherwise agreed in writing by both parties.

14.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent irreparable harm. Claims involving alleged violations of intellectual property rights, unauthorized use of our trademarks or copyrights, or violations of consumer protection statutes may also be brought in a court of appropriate jurisdiction where mandatory arbitration is not enforceable by law.

15. Term and Termination

These Terms shall remain in full force and effect for as long as you use our website or services or maintain an account with us.
